This policy describes the types of information we may collect from you or that you may provide when you visit this website, www.tabs3.com, and all other websites of Software Technology, LLC with authorized links to this Policy (collectively, the “Sites”), and our products and services available or enabled via the Sites (“Products and Services”).

Children Under the Age of 13

The Sites and the Products and Services are intended for adult audiences and are not intended for children under 13 years of age. In such instances, unless expressly provided to the contrary, the collection and use of your personal information will be governed by the privacy policy applicable to that site. Collection of Personal Information

As a visitor to the Sites, you can engage in many activities without providing any personal information. In connection with other activities, such as utilizing online or hosted Products and Services, Software Technology may ask you to provide certain information about yourself. We collect several types of information from and about users of our Sites and Products and Services, including information:

  • By which you may be personally identified, such as name, postal address, e-mail address, telephone number (“Personal Information”);
  • That is about you but individually does not identify you; and
  • About your internet connection, the equipment you use to access our Sites, and usage details.   • Information that you provide by filling in forms on our Sites. This includes information provided at the time of registering to use our Sites, subscribing to our Products and Services, or requesting further services. We may also ask you for information when you report a problem with our Sites.

We collect this information:

Depending upon the activity, some of the information that we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity. Similarly, if you wish to delete your information (pursuant to the mechanism set forth in “Accessing and Correcting Your Information”) that is mandatory, you will no longer be able to engage in that particular activity.

When you use the Sites and the Products and Services, Software Technology may also collect certain information about your computer to facilitate, evaluate and verify your use of the Sites and the Products and Services. Software Technology, LLC also uses such information to measure traffic patterns on the Sites and usage of the Products and Services. We do not match such information with personal information held about you by Software Technology unless we have your consent, except as otherwise described in this policy.

Third-Party Providers

By using the Sites and the Products and Services, you agree and acknowledge that with respect to certain activities, the collection, transfer, storage, and processing of your personal information may be undertaken by trusted third-party vendors or agents of Software Technology such as web-hosting providers and mail and email service providers, to help facilitate Software Technology in providing certain functions. It helps us to improve our Sites and to deliver better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our Sites according to your individual interests.
  • Speed up your searches.

Software Technology has established relationships with various providers of services and products who are not part of Software Technology and who may not themselves be providing products and services to Software Technology, or on Software Technology, behalf (“Providers”). Providers do not include third parties contracted by Software Technology to perform services on Software Technology’s behalf. The services of these Providers may be available to you from the Site, from websites that are linked to the Site, or in connection with the Products and Services. Typically, these Providers offer services that Software Technology customers might find useful, such as those that can be used in conjunction with Products and Services. In order to use Providers’ products and services, you may be required to provide personal information to the Providers or agree to allow Software Technology to share your personal information with such Providers. Unless expressly provided to the contrary, personal information that you provide while you are visiting a Provider’s website will be subject to the privacy policy posted on that site, and personal information that you provide while on the Sites will be subject to this policy.

In order to reduce errors in our database, authenticate our users, prevent fraud, and prevent abuse of our Sites and the Products and Services, as well as to provide more consistent, relevant experiences to our users, we may on occasion supplement or correct the personal information you submit to us and your Internet Protocol (IP) address with information in our other databases or information from third-party sources.

Tracking, Use of Cookies, Web Beacons, and Similar Devices

In order to improve our Products and Services and the Sites and provide more convenient, relevant experiences to our customers, we and our agents may use “cookies,” “web beacons,” and similar devices to track your activities. A cookie is a small amount of data that is transferred to your browser by a web server and can only be read by the server that gave it to you. It functions as your identification card and enables Software Technology, LLC to record your passwords and preferences. It cannot be executed as code or deliver viruses. A web beacon is a small transparent .gif image that is embedded in an HTML page or email and used to track when the page or email has been viewed.

Google Analytics

Google Analytics uses cookies to help the Sites analyze how users use the Site. The information generated by the cookie about your use of the Sites (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Sites, compiling reports on Sites activity for website operators, and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser or within the application, however, please note that if you do this you may not be able to use the full functionality of this Site. By using our websites, applications, or services you consent to the processing of data about you by Google in the manner and for the purposes set out above. Salesforce.com

Salesforce.com uses the Salesforce.com platform. You can view Salesforce.com’s privacy statements here which contain details of any cookies and analytics that are used within its platform and services: https://www.salesforce.com/company/privacy/full_privacy.jsp.

No service user data is maintained on the Salesforce web or application servers. Instead, after the user authenticates, the application generates a cookie for that user for only that session, with the following information: a version number that identifies the format of the cookie, a number that acts as the session ID, and a routing hint.

Google Ads

We use Google Ads, which enables us to advertise our website in Google search results, as well as on third-party websites. To this end, Google places a cookie in the browser of your terminal device, which automatically uses a pseudonymous cookie ID on the basis of pages you visited to allow interest-based advertising. Further information regarding advertising and Google can be viewed at https://policies.google.com/technologies/ads.

Most browsers are initially set to accept cookies, and most Products and Services that include similar devices are typically initially activated to collect data. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. (For some web pages that require authorization, cookies are not optional. Users choosing not to accept cookies or similar devices will probably not be able to access those pages or the related Products and Services.) Information about non-cookie tracking devices and their features, including disabling options, are contained in the information materials provided with such Products and Services or on Sites pages relating to such Products and Services.

We may ask you to provide information about others such as when reporting suspected piracy. In this instance, we will ask for the person’s or company’s name and contact information so that we may investigate. Personal information supplied in these instances will only be used for the purpose being submitted.

Software Technology also hires other companies to place our banner ads on other websites. Such companies perform tracking and reporting activities on ads served and user reaction (“Third-party Advertisement Servers”). They do not collect any information other than IP addresses and behaviors associated with those IP addresses on our behalf, and we do not give any personal information to them. Third-party Advertisement Servers are subject to their own privacy policies. Software Technology, LLC may also allow other companies to display advertisements on certain pages of the Sites or within the Products and Services. If you click on these advertisements these companies may place a persistent cookie on your computer which may allow them to display further advertisements to you. It is our policy to require these companies to provide accessible methods for you to disable these cookies. How Your Personal Information is Used

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Sites and their contents to you.
  • To provide you with information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • To allow you to participate in interactive features on our Sites.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

Software Technology may collect information about the use of the Products and Services and the Sites, such as the number of downloads, types of Services used, how many users we receive daily, Sites pages visited, and the IP address of your computer. This information is generally collected in aggregate form, without identifying any user individually, although IP address and Session ID in relation to downloads may be tracked as part of Software Technology’s fraud prevention efforts. Other exceptions to this, where an individual may be identified individually, are noted in this Privacy Policy or in additional privacy terms connected to a specific Product, Service or website.

Software Technology may provide your contact information to our credit card processing partners so that our partners may contact our customers about using one of our features that requires a credit card processing account. Software Technology does not process credit card information.

Certain Products and Services may require you to use the most current version of such Product and Service or are offered in conjunction with other Products and Services, which you may or may not have already downloaded. The Product and Service may automatically check to determine if you are using the most current version or have other Products and Services and through email messages, pop-up boxes or similar mechanisms inform you if you need to upgrade in order to use the Product and Service you have requested. During this process, an IP address identifying your computer and the Product and Service version may be sent to a Web server, but system profile information is not transmitted nor are cookies used to store information.

We may disclose personal information that we collect or you provide as described in this privacy policy:

Except in the particular circumstances described in this policy, Software Technology will not provide your name to other companies or organizations without your consent. If you have opted to receive email communications from our selected Providers and later wish to discontinue receipt of these emails, please contact those third parties directly to update your preferences.

There are other instances in which Software Technology may divulge your personal information, such as when required by law, regulation, or litigation. We may also disclose information about you if we determine that such disclosure should be made for reasons of national security, law enforcement, or other issues of public importance.

Our Sites collect information that identifies, relates to, describes, references are reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information”). Personal information does not include:

We do not collect any sensitive personal information.

Personal information collected by Software Technology will be retained only as long as necessary to carry out the purposes described herein. We may share personal information with third party recipients in furtherance of these purposes as described below.

We do not sell personal information. We may share your personal information with our affiliates.

Your Rights and Choices

The CCPA provides California residents with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:

Right to Correct

You have the right to request that we correct any inaccurate personal data we maintain about you.

Right to Delete

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the “right to delete”). Once we receive your request and confirm your identity (see Exercising Access, Data Portability, and Deletion Rights), we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.

  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or de-identify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

Exercising Access, Data Portability, Correction, and Deletion Rights

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include:
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact 402-423-1440  ext. 194. We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you with a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.
